Terms and Conditions of Use of the Platform

1.  Introduction.

We thank you for choosing to use our platform. We want your experience with us to be as positive as possible, and for this reason we have drafted these terms in the most transparent way.

To access our services, you declare that you are of legal age and have the legal capacity to act in accordance with the laws of your country of residence.

For the purposes of this document, any person who accesses, browses or uses the platform—whether as a registered or unregistered user—shall be considered a user of the platform. The USER and FMHOUSE, S.L., owner of the PLATFORM, may be jointly referred to as the Parties.

Access to and use of our PLATFORM, or of any of its services, constitutes the express and full acceptance of each and every one of these General Terms and Conditions, including any applicable Specific Terms and the Privacy Policy, which explains the purposes for which we process the data you provide to us. We strongly recommend that you read them carefully.

By accessing and using the PLATFORM, the user declares that all information provided is true and accurate, without omissions, restrictions or falsehoods; the user also undertakes to keep all such information permanently up to date, being solely responsible for any incorrect, false or inaccurate statements made.

2. Terms and Conditions of Use.

Los presentes términos y condiciones de uso de la plataforma, en adelante “TCU” regulan el acceso y la utilización de la plataforma, incluyendo los contenidos y los servicios puestos a disposición de los usuarios a través de la PLATAFORMA, bien por FMHOUSE, S.L., bien por sus usuarios o por cualquier tercero. No obstante, el acceso y la utilización de ciertos contenidos y/o servicios pueden encontrarse sometidos a determinadas condiciones específicas.

3.  Modifications.

FMHOUSE, S.L. reserves the right to modify these Terms and Conditions of Use of the PLATFORM at any time. In any case, users are advised to consult them periodically, as they may be subject to change.

4. Information and Services.

Users may access various types of information and services through the PLATFORM. FMHOUSE, S.L. reserves the right to modify, at any time and without prior notice, the presentation and configuration of the information and services offered via the PLATFORM.

The user expressly acknowledges and accepts that FMHOUSE, S.L. may, at any time, interrupt, disable and/or cancel any information or service. FMHOUSE, S.L. will make its best efforts to ensure the availability and accessibility of the PLATFORM. However, access to the PLATFORM may occasionally be interrupted due to maintenance, updates, relocation or similar reasons.

5. Availability of PLATFORM Information and Services

FMHOUSE, S.L. does not guarantee the continuous or permanent availability of the services, and is therefore exempt from any liability for potential damages or losses resulting from the unavailability of the service due to force majeure, errors in data transmission networks beyond its control, or disconnections carried out for the purpose of improving or maintaining computer systems and equipment.

In such cases, FMHOUSE, S.L. will make its best efforts to restore full availability of the services and to inform users of any possible interruptions. FMHOUSE, S.L. shall not be held liable for the interruption, suspension, or termination of any information or services. Likewise, it shall not be held responsible for any omissions, loss of information or data, configuration errors, unauthorised access, or breaches of confidentiality arising from technical issues, communication failures, or human errors caused by third parties or not attributable to FMHOUSE, S.L.

FMHOUSE, S.L. shall also not be liable for damages caused by cyberattacks or by viruses that affect software, communication systems, or equipment used by FMHOUSE, S.L. but manufactured or supplied by a third party.

FMHOUSE, S.L. may, at its sole discretion and without prior notice, deny, remove, suspend and/or block access to information or services at any time to users who breach these terms.

6. Liability of the PLATFORM

Except in those cases where the law expressly states otherwise, and only to the extent and under the conditions established by law, FMHOUSE, S.L. does not guarantee and assumes no liability whatsoever for any damages or losses that may arise from the use of the information, data, and services provided through the PLATFORM.

In any case, FMHOUSE, S.L. shall be exempt from any liability for damages that may result from information and/or services provided or supplied by third parties other than FMHOUSE, S.L. In such cases, all liability shall lie solely with the third party, whether acting as provider or collaborator.

7. User Obligations

The user must at all times comply with these Terms and Conditions of Use of the PLATFORM. The user expressly declares that they will use the PLATFORM diligently and shall assume any liability that may arise from failure to comply with the rules.

Where the user is required to provide data or information, they undertake not to falsify their identity by impersonating any other person. The user accepts that their use of the PLATFORM shall be exclusively for personal, private and individual purposes. The user may not use the PLATFORM for activities that are unlawful, immoral or contrary to public order, nor for purposes that are prohibited or that infringe upon or harm the rights of third parties.

Likewise, it is strictly forbidden to disseminate, store and/or manage data or content that violates third-party rights or any regulations governing intellectual or industrial property rights.

The user may not use the PLATFORM to transmit, store, disclose, promote or distribute data or content that contains viruses or any other type of computer code, files or programs designed to interrupt, destroy or impair the functioning of any software, hardware or telecommunications equipment.

The user agrees to indemnify and hold FMHOUSE, S.L. harmless from any damage, loss, penalty, fine or compensation that FMHOUSE, S.L. may be obliged to bear as a result of the user’s failure to comply with the obligations set out in this document.

8. Personal Data

The personal data or information provided by the user shall be processed in accordance with the provisions set out in the Privacy Policy included on the PLATFORM.

9. Links to Other Websites

FMHOUSE, S.L. does not guarantee and assumes no responsibility whatsoever for any damages or losses that may arise from access to third-party services via connections, hyperlinks or links to linked websites, nor for the accuracy or reliability of such websites.

The sole purpose of the links provided is to inform the user of the existence of other sources of information available on the Internet, through which the services offered via the Portal may be extended. FMHOUSE, S.L. shall in no case be held responsible for the results obtained through such links or for any consequences arising from users accessing them.

These third-party services are provided independently by the respective third parties, and FMHOUSE, S.L. does not and cannot control either the legality or the quality of such services. Therefore, users are advised to exercise extreme caution when assessing and using the information and services contained in third-party content.

10. Intellectual and Industrial Property

All content, trademarks, logos, designs, documentation, software or any other elements that may be protected under intellectual or industrial property laws and that are accessible through the PLATFORM are the exclusive property of FMHOUSE, S.L. or of their rightful owners. All rights over such elements are expressly reserved.

The creation of hyperlinks to any component of the PLATFORM is expressly prohibited without the prior authorisation of FMHOUSE, S.L., except where such links lead to sections of the PLATFORM that do not require identification or authentication to access, or where such access is not restricted.

In all cases, FMHOUSE, S.L. reserves all rights over the content, information, data and services that it owns. FMHOUSE, S.L. does not grant the user any licence or authorisation to use its content, data or services other than that which is expressly detailed in these Terms and Conditions of Use of the PLATFORM.

11. Intellectual and Industrial Property of Submitted Proposals

The intellectual and industrial property rights over any proposals, ideas, technical solutions, documents, developments or any other material submitted by participants within the framework of challenges or calls promoted by FMHOUSE, S.L. shall remain the property of the respective participants

However, by accepting the terms of participation, participants grant FMHOUSE, S.L. a non-exclusive, royalty-free, worldwide licence for the maximum period permitted by applicable law to use, reproduce, analyse, publicly communicate and evaluate such proposals, solely for the purpose of managing and assessing their suitability for the corresponding challenge. This shall not constitute a transfer of intellectual property rights.

Under no circumstances may FMHOUSE, S.L. commercially exploit the submitted proposals without the express prior written authorisation of the rights holder.

Participants warrant that the submitted proposals are original, do not infringe any third-party rights, and that they hold all the rights necessary to grant the licence described above. Otherwise, they shall be solely liable for any infringement that may arise, and shall hold FMHOUSE, S.L. harmless against any third-party claims.

12. Applicable Law, Jurisdiction and Notifications

These Terms and Conditions of Use of the PLATFORM shall be governed by and interpreted in accordance with Spanish law. For any claims or legal actions, the courts and tribunals of Spanish territory shall have jurisdiction.

All notifications, requirements, requests and other communications that the User wishes to address to FMHOUSE, S.L., the owner of this PLATFORM, must be made in writing and shall be deemed to have been properly delivered when received at the following address: info@fm-house.com.
